Ethics Advice

The practice of law can be challenging and may, at times, feel like you are going through white water rapids without a guide.  I assist firms in managing ethical rapids, with the following services:

  • Analyze and advise on conflicts of interest situations
  • Draft and revise fee agreements for ethics compliance
  • Review and counsel on firm social media policies
  • Advise on law office practice management requirements
  • Evaluate firm trust account documentation procedures and internal controls for compliance with Arizona Supreme Court Rule 43
  • Assist with ancillary business procedures, documentation, and required disclosures
  • Counsel firms on ethical obligations in lawyer departures and dissolutions of firms
  • Draft and examine firm client intake/calendaring/communication/conflict checking protocols
  • Advise on ethical billing procedures and training for timekeepers
  • Assist with firm risk management in client disputes, bar charges and fee arbitrations
  • Review and monitor firm marketing campaigns, advertising, firm name changes and national ethics compliance.
  • Coordinate with firm marketing consultants on solicitation and firm’s social media presence.
  • Evaluate firm paraprofessional supervision policies and procedures
  • Advise on office sharing protocols and of-counsel relationships between firms.

  • Review data retention agreements for ethics requirements to maintain client confidential information and document retention policies.
  • Assist with responses to initial Bar inquiries and coordinate with litigation counsel where necessary
  • Provide prompt confidential ethics advice by telephone, email or in-person.
  • Consult on law firm transitions including lawyers leaving, lawyers joining, firm dissolutions and firm openings.
